1. Introduction

Welcome to UrSheBear (https://urshebear.co.za). These Terms and Conditions govern your use of our website and the purchase of our products and services. By accessing our site and purchasing our tarot/oracle decks, digital PDF downloads, or intuitive readings, you agree to be bound by these terms.

2. Merchant Outlet Country and Transaction Currency

UrSheBear is a registered business operating in South Africa. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. All transaction currencies and prices are presented in South African Rand (ZAR).

3. Payment Processing via PayFast

Payments are securely processed via PayFast by Network, our authorized payment gateway. UrSheBear accepts payments via Credit Cards (Visa and Mastercard), Instant EFT, and other available PayFast payment methods. No credit card details are stored on our website. Customer personal data is stored separately from payment details to ensure complete security.

4. Direct Marketing & Communications

By providing your details at checkout, you consent to receive direct fulfillment communications (such as delivery updates or download links). You may opt out of promotional communications at any time.

5. Age Restrictions

By purchasing spiritual tools or readings, you warrant that you are at least 18 years of age or have the consent of a legal guardian to use this site.

6. Disclaimer of Services

Tarot, oracle, and intuitive readings offered by UrSheBear are intended solely for personal guidance and entertainment purposes. They do not substitute for professional medical, legal, financial, or psychological advice.

7. Domicilium Citandi Et Executandi

This website is governed by the laws of South Africa. UrSheBear chooses its domicilium citandi et executandi for all purposes under this agreement as: Meadhurst Smallholding, Bloemfontein, South Africa.

8. Refund and Cancellation Policy

Physical Goods (Tarot & Oracle Decks): In accordance with Section 44 of the South African Electronic Communications and Transactions (ECT) Act, you have a 7-day cooling-off period to return physical items for a full refund. The deck must be unopened, unused, in its original plastic wrap/packaging, and undamaged. The customer is responsible for the direct shipping costs of returning the item. If your original order qualified for Free Delivery (over R850.00) and a partial return drops your remaining order total below R850.00, the standard courier fee will be deducted from your final refund amount.
Damaged or Defective Goods: If a physical deck arrives damaged, you are protected under Section 56 of the Consumer Protection Act (CPA). Please contact us at [Your Email Address] with photos within 24 hours of delivery for a free replacement or full refund.
Digital PDF Downloads: Due to the immediate access nature of digital files, all sales for items in our Esoteric Library are final and strictly non-refundable. The 7-day cooling-off period does not apply to digital downloads once the link is delivered.
Personal Tarot Readings: You may cancel a reading request for a full refund before the service has been performed. Once your reading has been completed and sent to your email within our 24-to-48-hour window, no refunds can be issued.

9. Delivery and Shipping Policy

Physical Shipping Carrier: All physical decks are shipped within South Africa using The Courier Guy or Pudo (Locker-to-Locker / Kiosk-to-Locker).
Shipping Rates & Free Shipping Threshold: We offer Free Shipping on all physical orders with a total checkout value of R850.00 or more. For orders under R850.00, standard carrier flat rates apply at checkout.
Main Center Free Shipping: Orders qualifying for free shipping (over R850.00) destined for main metropolitan centers (major hubs within Johannesburg, Pretoria, Cape Town, Durban, Bloemfontein, Port Elizabeth, and East London) will be delivered door-to-door via The Courier Guy.
Regional & Outlying Area Free Shipping: Free shipping requests to remote locations, small towns, farms, or townships are strictly restricted to Pudo Locker-to-Locker collection due to high courier surcharges. If you qualify for free shipping in an outlying zone, please specify your preferred Pudo Locker address in the order notes at checkout, or we will default to the locker closest to your physical address. **Or choose to upgrade to Premium Regional Door delivery rates.
Processing & Delivery Timelines: Orders are packed and dispatched from our smallholding within 1–2 business days of payment clearance. Delivery takes 2 to 5 business days depending on your location. A tracking number will be emailed to you immediately upon dispatch.
Locker Collection Window: For all Pudo locker deliveries, parcels must be collected within 36 hours of receiving your SMS notification PIN code to prevent the package from being automatically returned to the warehouse.
Digital Item Delivery: Digital PDFs from The Esoteric Library are delivered instantly via an automated email containing a secure download link as soon as your PayFast payment clears.
Service Delivery: Personal tarot and oracle readings are digital services delivered directly to your provided email address within 24 to 48 hours of receiving your payment and reading focus questions.

Refund and Returns Policy

1. Physical Products (Tarot & Oracle Decks)

7-Day Cooling-Off Period: In accordance with Section 44 of the South African Electronic Communications and Transactions (ECT) Act, you have the right to cancel your purchase of physical decks within 7 days of receiving the item, for any reason, without penalty.
Condition of Returns: To qualify for a full refund under the cooling-off period, the physical deck must be unopened, unused, in its original plastic wrap/packaging, and completely undamaged.
Return Shipping Cost: The consumer bears the direct shipping cost of safely couriering the physical deck back to UrSheBear. If your partial return causes your order value to drop below our R850.00 free shipping threshold, the standard cost of your original shipping will be deducted from your refund balance.
Defective Goods: If a deck arrives damaged or structurally defective, you are protected under Section 56 of the Consumer Protection Act (CPA). Please notify us immediately at [Your Email Address] with photographs. Defective items will be replaced or refunded in full at our expense within 15 business days of verification.

2. Digital PDF Downloads (Esoteric Library)

Due to the immediate access nature of digital files, all sales for PDF downloads (such as The Activated Human, Arcane, etc.) are final and strictly non-refundable.
According to South African law, the 7-day cooling-off period does not apply to digital downloads once the download link has been generated or delivered to your inbox. If your file link is broken or corrupted, contact us immediately for a fresh copy.

3. Personal Tarot & Oracle Readings

Cancellations: You may cancel a personal reading request for a full refund before the reading has been performed.
Non-Refundable Window: Once your intuitive reading has been completed and delivered via your chosen medium within our 24-to-48-hour service window, no refunds can be issued. The service right of cooling off lapses as soon as the service has been performed and delivered.

Shipping and Delivery Policy

1. Physical Goods Delivery

We ship all physical tarot and oracle cards across South Africa using premium local couriers: The Courier Guy or Pudo (Locker-to-Locker).

Free Shipping Framework: We offer Free Shipping on all physical orders over R850.00. For orders under R850.00, standard carrier flat rates apply at checkout.
Main Centers (Major Cities): Orders over R850.00 receive FREE Door-to-Door Delivery via The Courier Guy. (Main centers include major metropolitan areas within Johannesburg, Pretoria, Cape Town, Durban, Bloemfontein, Port Elizabeth, and East London).
Regional & Outlying Areas (Small Towns, Townships, Farms): Orders over R850.00 receive FREE Pudo Locker-to-Locker Delivery. Due to high regional surcharges, free door-to-door delivery is not available for outlying areas. Please specify your preferred Pudo Locker address in the order notes at checkout. If a locker is not specified, we will default to the locker closest to your physical address.
Processing Time: Orders are packed and dispatched from our smallholding within 1–2 business days from clear payment confirmation on PayFast.
Delivery Timeline: Standard shipping takes 2 to 5 business days depending on your location (major centers are generally faster, while remote areas may require the full 5 days).
Locker Collection Timeline: Pudo packages must be collected from your destination locker within 36 hours of receiving your unique SMS PIN code notification to avoid warehouse return procedures.
Tracking: A tracking number will be emailed to you as soon as your parcel is handed over to the courier service.

2. Digital PDF Delivery (Esoteric Library)

Instant Access: Digital book downloads do not require physical shipping.
Fulfillment: Upon successful PayFast checkout clearance, an automated email containing a secure download link is instantly generated and delivered to your provided email address.

3. Personal Readings Delivery

Service Delivery: All personal tarot readings are digital services and do not require physical shipping.
Turnaround Time: Your reading will be generated, compiled, and dispatched to your provided email address within 24 to 48 hours from the time clear payment and your reading focus/questions are received.

When you purchase from UrSheBear, we collect essential personal information required to fulfil your order:

Identity Data: First name, last name.
Contact Data: Email address, phone number, physical/delivery address.
Transaction Data: Details about items purchased, date, and payment status.

2. How Your Data is Used & Shared (PayFast & Courier Integration)

Your information is processed strictly to complete your sale. We share data with third-party providers only to fulfil your transaction in compliance with POPIA:

Payment Gateway: We share your name, transaction totals, and contact information with PayFast by Network so they can securely process your credit card or EFT payments. We do not collect, view, or retain your payment card details.
Courier Fleet: We share your name, phone number, and physical/delivery address with The Courier Guy or Pudo to ensure accurate door-to-door or locker delivery. Third-party logistics systems are strictly restricted from utilizing your personal data for any purpose outside of executing your shipment delivery.

3. Data Retention and Security

Your personal details are stored on secure WordPress servers utilizing modern encryption protocols. We retain transaction details to comply with South African tax laws. Your information is never sold, traded, or shared with external marketing brokers.
